La D Da Lodge – Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern all bookings, stays, services, and use of the premises of La D Da Lodge, Kimberley, Northern Cape (“the Lodge”, “we”, “us”, “our”).
By making a booking, entering the premises, or using any services, you (“the Guest”) agree to be bound by these Terms.
2. Booking & Acceptance
2.1 A booking shall be deemed confirmed once a guest accepts a quotation, indicates by any form of communication (including but not limited to email, telephone, messaging services, online platforms, or written correspondence) their intention to make use of a room for the dates quoted, makes a full or partial payment, or physically occupies or enters the room or premises for the quoted dates.
2.2 Acceptance of these Terms and Conditions, the Privacy Policy, House Rules, and Indemnity Agreement occurs automatically upon confirmation of the booking, check-in, communication confirming the use of a room, or physical occupancy of the accommodation.
2.3 Failure to read or review these documents does not exempt the Guest from compliance with their contents.
3. Right to Refuse, Cancel, or Withhold Services
3.1 The Lodge reserves the absolute right, at its sole discretion, to:
- Refuse accommodation or services
- Cancel any booking at any time
- Withhold access to facilities, services, security deposits, or property
3.2 Cancellation may occur with or without prior notice and without obligation to provide a reason, subject to applicable law.
3.3 Where a booking is cancelled by the Lodge, refunds are not guaranteed.
4. Non-Refundable Cancellations – Example Scenarios
Refunds may be refused (including but not limited to) the following scenarios:
- Violation of House Rules
- Aggressive, abusive, illegal, or unsafe conduct
- False, misleading, or incomplete booking information
- Over-occupancy or unauthorized guests
- Damage or risk of damage to property
- Failure to comply with security, safety, or staff instructions
- Suspected fraud, chargeback risk, or payment disputes
- Operational, reputational, or safety concerns
This list is illustrative and not exhaustive.
5. Settlement, Set-Off & Withholding Rights
5.1 The Lodge may retain or withhold any of the following as part of a settlement or dispute resolution:
- Security deposits
- Prepaid accommodation or services
- Access to facilities or property
- Guest property left on premises (subject to law)
5.2 Any withheld amounts may be applied toward damages, losses, cleaning, legal costs, or unpaid charges.
6. Guest Obligations
Guests agree to:
- Act lawfully and respectfully
- Comply with House Rules and staff instructions
- Use the premises at their own risk
- Accept responsibility for guests under their care
7. Guest Liability, Damages & Loss
- The Guest accepts full responsibility for any damage, theft, loss, or destruction of property belonging to La D Da Lodge, its staff, contractors, or other guests, caused directly or indirectly by:
- The Guest
- Any member of the Guest’s party
- Any visitor permitted onto the premises by the Guest
- This includes, but is not limited to:
- Physical damage to rooms, furniture, fixtures, fittings, or equipment
- Theft or loss of Lodge property
- Excessive cleaning or repairs required
- Loss of income resulting from unusable accommodation
- The Guest agrees to settle all such damages in full, upon demand, including reasonable repair, replacement, administrative, and legal costs.
- The Lodge may apply any security deposit, prepaid amount, withheld service, or retained property toward settlement of such damages, without prejudice to any further legal remedies.
8. Limitation of Liability
To the fullest extent permitted by South African law, the Lodge is not liable for loss, injury, damage, or death arising from the Guest’s stay, except where caused by gross negligence or wilful misconduct.
9. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
